as per proceedings of the third respondent in Mu.Mu.A2/1365/2011 dated 28.07.2011 and further direct the respondents to refund Rs.2,61,844 to the petitioner herein.

ORDER
The present writ petition has been filed by a retired Deputy Tahsildar challenging the order passed by the third respondent dated 17.02.2017 wherein pay scale of the petitioner has been revised and an order of recovery has already been passed.
2. According to the learned counsel appearing for the writ petitioner, the said order has been passed without providing any opportunity to the writ petitioner. A perusal of the impugned order also confirms the same.
3. In view of the above stated facts, without going into the merits of the averments in the writ petition, the orders impugned in this writ petition are set aside and the matter is remanded back to the file of the 2/5
third respondent. The third respondent is directed to issue show cause notice to the writ petitioner. The writ petitioner is directed to submit his explanation within a period of four weeks from the receipt of the show cause notice. After considering the contentions raised by the writ petitioner in his explanation, the third respondent is directed to pass fresh orders.
4. With the above directions, this writ petition is allowed. No costs. 12.09.2025 Index : Yes / No NCC : Yes / No CM 3/5
