Respondent/Contemnor Contempt Petition filed under Section 11 of Contempt of Court Act, 1971 praying to punish the respondent for his wilful and deliberate disobedience to the orders of this Honourable Court dated 11.02.2016 in W.P(MD) No.1850 of 2016. Prayer in WP(MD). 1850/ 2016 : Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the first respondent i.e., the Secretary to Government, Finance Department, Chennai to consider the petitioners representation dt.19.12.2015 and pass appropriate orders regarding his notional promotion on par with his junior Tmt.Thilagavathi (serial No.194) by granting exemption for not passing the Departmental Test as per Govt. Letter No.9140/Service/M/89 dt.20.11.89 and refixation of pension within a specified time frame that may be fixed by this Hon'ble High Court.

ORDER

This Court by the order dated 11.02.2016 directed the respondent to consider the representation of the petitioner dated 19.12.2015 with the available records maintained by the Department and pass appropriate orders on merits and in accordance with law within a period of three months from the date of receipt of a copy of the order.

2.Contending that there is no compliance of the order and the conduct exhibited by the respondent amounted to willfull disobedience to the order passed by this Court, this Contempt Petition has been filed.

3.Learned Additional Government Pleader appearing for the respondent has produced a copy of the proceedings dated 16.09.2016 in Rc.No.7849/N1/2015, whereunder, it is stated that the name of the petitioner is included in the 2006-07 panel. 4.Nothing survives for adjudication as the compliance has been reported. Hence, the contempt petition is closed.
