Poomani ....Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 2nd respondent to cancel the forged patta in Survey numbers 14/6, 14/7A3, 14/7C, 21/6B, 269/2B2B, 136/3A, 136/3B, 136/3C in Patta No.2871 of Muthalikulam Village, Usilampatti Taluk, Madurai District and Subsequently direct the 3rd respondent to give the joint patta to the legal heirs of the petitioner deceased father as per the Legal heirship Certificate based on petitioner representations dated 07.08.2023 and 29.07.2025.

ORDER

By tracing title from his grandfather Mayandi Devar, the petitioner assails patta No.2871 by filing an appeal before the second respondent herein. By this writ petition, the petitioner seeks a direction in relation thereto. 2.Learned Additional Government Pleader accepts notice on behalf of the respondents 1 to 3. On the basis of written instructions, including the relevant extract from "A' Register, he points out that the survey Nos.136/3A, 136/3B and 136/3C stood in the name of Mayandi Devar and Subba Vellai Mayandi. He further submits that the second respondent would consider and dispose of the petitioner's request on merits within twelve weeks. 3.Patta No.2871 stands in the name of Tamil Selvam, who is said to be the elder brother of the petitioner. According to the petitioner, joint patta should have been issued and not an individual patta. Needless to say, the petitioner's request can only be considered after putting not only the pattadhar but the other legal heirs of Mayandi Devar and Devaraj on notice. 2/4

4.Subject to the above observations, without going into the merits, this writ petition stands disposed of by directing the second respondent to conduct an inquiry and issue a reasoned order after providing a reasonable opportunity to the petitioner, the private respondents herein and any other persons interested in the relevant property. No costs.
