Prayer: Petition filed under Article 226 of the Constitution of India praying to issue Writ of Declaration declaring the participation and the acceptance of the bid submitted by the 3rd respondent in the price bid opened on 09.10.2017 in pursuant to the tender notification No. R34/RUSA/ADVT/2017 on the file of the 1st respondent as illegal, null and void and further directing the respondents 1 and 2 to award the contract under the said tender notification to the petitioner. ORDER

The petitioner, with an allegation that the first respondent University has preferred to allot the work to a person who is not having the required qualification, has filed this Writ Petition for a Declaration to declare the participation and acceptance of the bid submitted by the third respondent, pursuant to the tender Notification issued by the first respondent, as illegal.

2. When the matter is taken up for hearing today, the learned counsel appearing for the third respondent submits that as per the terms and conditions of the contract, the third respondent has fulfilled all the required qualifications and therefore, the third respondent was awarded with the contract.

3. Recording the submission made by the learned counsel appearing for the third respondent, this Writ Petition is closed. There shall be no order as to costs.
