ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent.

2. The petitioner apprehending arrest at the hands of the respondent police for the offences under section 302 of I.P.C. @ https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.19525 of 2019 into Sections 147, 148, 341, 294(b), 302 and 506(ii) of I.P.C. r/w. Section 120(b) of I.P.C., in Crime No.340 of 2019, on the file of the respondent police, seeks anticipatory bail.

3. The petitioner along with other two accused had earlier filed two petitions for anticipatory bail. Both were dismissed. In fact the second petition for anticipatory bail was dismissed with a cost of Rs.5,000/-. Without disclosing the same, this third petition has been filed by claiming that this is the first anticipatory bail petition filed before this Court. I gave chance to the petitioner's counsel. If the petitioner is willing to surrender, then this Court would dismiss this petition without levying any costs. The case was passed over to enable the petitioner's counsel to get instructions.

4. When the matter was taken after being passed over, the petitioner's counsel states that the petitioner would surrender before the respondent police at the earliest and without any delay.

5. Recording the said undertaking, this criminal original petition is dismissed.
