Prayer: Contempt Petition - filed under Section 11 of Contempt of Courts Act 1971, to initiate appropriate contempt proceedings against the respondents for willful and deliberate disobedience of the order passed by this Court in W.P.(MD)No.21031 of 2015, dated 26.11.2015.

Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to consider the claim of the petitioner along with others for appointment to the post of junior Draughting Officer by relaxing the maximum age limit fixed in the notification No. 12390/Nir 5(1)/ 2014 dated 26.10.2015 calling for applications for filling up the post of Junior Draughting Officer in the Highways Department in respect of the petitioner in terms of Rule 12(d) and Rule 50 of the Tamil Nadu State and Subordinate Service Rules.

ORDER
The contempt petition has been filed to initiate appropriate contempt proceedings against the respondents for willful and deliberate disobedience of the order passed by this Court in W.P.(MD)No.21031 of 2015, dated 26.11.2015. 2.
Heard Mr.S.Govindan, learned counsel for the petitioner, Mr.B.Pugalendhi, learned Additional Advocate General assisted by Mr.C.Selvaraj, learned Special Government Pleader for the respondents and perused the records.
3. When the matter is taken up for hearing today, the learned Additional Advocate General appearing for the respondents would submit that a writ appeal in W.A.(MD)No.1441 of 2017 has been filed against the order made in W.P.(MD)No.21031 of 2015 and the writ appeal has been listed for final hearing.
4. Considering the above-stated facts and circumstances, this contempt petition is closed, however with liberty to the petitioner to revive the same in the event of his success in the writ appeal. No costs.
