For Respondent : Mr.R.SURESH KUMAR, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.177/2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioners/accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 467, 471, and 420 IPC in Crime No.177 of 2023, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner and the defacto complainant are brothers. When the defacto complainant went to the Canada for working, the 1/3

petitioner had brake open the bureau and taken away documents and also created forged documents, as if, the defacto complainant has executed gift deed to the petitioner. Hence, the complaint.

3.The learned counsel appearing for the petitioner would submit that the petitioner is innocent person and he has not committed any offence as alleged by the prosecution. Hence, he prays for anticipatory bail to the petitioner. 4.The learned Government Advocate (criminal side) appearing for the respondent police has strongly opposed to grant anticipatory bail to the petitioner. 5.Heard both sides and perused the materials available on the record.

6. It is seen that the crime committed by the petitioner is not an accidental crime and it is a planned crime. Therefore, considering the nature of the offence, this Court is not inclined to grant anticipatory bail to the petitioner. Hence, this Criminal Original Petition is dismissed.
