ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 23.04.2025 for the offences punishable under Sections 8(c) r/w 20(b) (ii) (A), 22(b), 22(c), 27(a) of NDPS Act, 1985, in Crime No.292 of 2025 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that on 22.04.2025 at about 05.30 p.m., the respondent police received secret information regarding the sale of narcotic substances. Upon receipt of the said information, the respondent police conducted surveillance near UDC College, Thiruverumbur, where two persons were found standing in a suspicious manner. On noticing the presence of the police, the said persons attempted to flee from the spot. However, they were apprehended and subjected to inspection. Upon inspection, A1 was allegedly found in possession of 16 MDMA tablets (weighing about 7.1 grams), O.G. Ganja weighing about 2 grams and 4 grams kept in separate zip-lock covers, one Apple iPhone and one Redmi mobile phone. Subsequently, on the same day at about 10.10 p.m., based on the alleged confession of A1 and A2, the respondent police proceeded to the house of the petitioner/A3, 2/7
arrested him and seized 45 MDMA tablets (weighing about 20.02 grams) and 5 MDMA tablets (weighing about 2.08 grams) kept in separate ziplock covers, Methaqualone weighing about 9 grams and Ganja weighing about 10 grams.
3. The learned counsel for the petitioner further submitted that the petitioner is an innocent person. He contended that the petitioner was implicated in the case only on the basis of the alleged confession of A1 and that no independent recovery was effected from the petitioner. Therefore, he prayed for the grant of bail to the petitioner.
4. The learned Additional Public Prosecutor further submitted that, based on the confession of the A1, the respondent police proceeded to the house of the petitioner. It is alleged that, at the time of search, the petitioner was found in possession of two zip-lock covers kept in his pant pocket, containing separate white crystal-like substances and orange and green tablets. He was also found to be in possession of an Apple mobile phone. He further submitted that the respondent police seized the following contraband and articles from the petitioner: (i) MDMA weighing about 20.2 grams (45 orange-coloured tablets 3/7
in a zip-lock cover);
(ii) MDMA weighing about 2.08 grams (5 green-coloured tablets in a zip-lock cover);
(iii) Methaqualone weighing about 9 grams (in a small zip-lock cover);
(iv) Cannabis weighing about 10 grams (in a small zip-lock cover); v) One Apple mobile phone;
(vi) One electronic weighing machine; and (vii) One small electronic weighing machine.
Hence, he vehemently opposed the grant of bail to the petitioner.
5. Taking into consideration the facts and circumstances of the case, and in view of the specific overt act attributed to the petitioner, which involves commercial quantity, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
