Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a WRIT OF MANDAMUS directing the respondents to grant the petitioner 4th and 5th review benefits and revise his pay in the post of Checking Inspector with retrospective effect from 01.09.2010 in terms of Government Order in G.O.Ms.No.61 Transport(C1)Department dated 30.04.2015 and as per 12(3) settlement dated 22.01.2011 and further directing the respondents to pay the petitioner difference amount in his salary from 01.09.2010 to 30.06.2013 and to pay difference in petitioner's retirement benefits including difference in monthly pension, gratuity, leave salary, commuted value of pension and all other attendant benefits payable to the petitioner from 01.07.2013 to till date together with interest at the rate of 18% per annum. ORDER
The contempt petition has been filed to take the petitioner's contempt application on its file and issue statutory notices to the contemnor and while dealing with in accordance with the law award maximum punishment to the contemnor for the willful disobedience in complying with the direction of this Court in W.P. (MD)No.21973 of 2015, dated 09.12.2015.
2. Heard Mr.Ramprakash Rajagopal, learned counsel for the petitioner, Mr.D.Sivaraman, learned counsel for the respondent and perused the records.
3. The learned counsel for the respondent would submit that the difference in retirement benefits of Rs.1,25,029/-, the gratuity amount Rs.46,734/- and the leave salary of Rs.58,708/- were already paid to the petitioner. He has also produced the letter sent by the respondent dated 01.11.2017.
4. Recording the submission made by the learned counsel appearing for the respondent, this contempt petition is closed. No costs. Consequently, the connected Sub Application is closed.
