Contemnor/Respondent PRAYER: Petition is filed under Section 11 of Contempt of Courts Act, to punish the respondent / contemnor for the willful disobedience of the order dated 20.04.2015 in W.P.(MD)No.5981 of 2015.

Prayer in WP(MD). 5981/ 2015 : Petition is filed under Article 226 of the Constitution of India, for the issue of a writ of Mandamus to direct the respondents to issue pension and provide the entire retirement benefits to the petitioner based on the representation dated:24.2.2015.

O R D E R

The petitioner has come forward with the present Contempt petition to punish the respondent for the willful disobedience of the order dated 20.04.2015 in W.P.(MD)No.5981 of 2015. 2.The learned standing counsel appearing for the respondent submitted that the respondent has already started for paying pension from March 2016 onwards and the entire pensionary benefits will be settled in 12 monthly instalments as per the Judgment of the Hon'ble Division Bench of this Court. He produced a letter dated 01.10.2016 to that effect. https://hcservices.ecourts.gov.in/hcservices/ 3.The learned counsel for the petitioner submitted that

gratuity amount has not been paid so far.

4.Heard the learned counsel for the petitioner and the learned standing counsel appearing for the respondent. 5.In view of the submissions made on either side and also the decision of the Hon'ble Division Bench of this Court, the respondent shall pay the gratuity payable to the petitioner by 12 monthly instalments commencing from 5th January 2017 and the subsequent month on or before 5th of every month. The contempt petition is closed accordingly. No costs.
