Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus calling for the records pertaining to the impugned order issued by the 3rd respondent in PR/73/98 dated 09.04.1999 and quash the same and consequently direct the respondents herein to pay the usual increments and also differences in the payment of petitioners salary from the date of petitioners reinstatement so also promotion on the basis of the petitioners representation dated 20.10.2016 within the time stipulated by this Court.

ORDER

The present writ petition was initially filed seeking conferment of promotion and annual increment. Later it was amended seeking to quash the dismissal order, dated 09.04.1999. Even though the prayer in the writ petition was amended, the body or the grounds of the writ petition have not been amended.

2.In view of the above said facts, the petitioner has now filed the affidavit, dated 01.09.2025. Paragraph Nos.2 and 3 of the affidavit is extracted as follows:

"2. I further submit that during the pendency of the above writ petition I have also filed a Writ Miscellaneous Petition in W.M.P(MD)No.19976 of 2025 seeking for amendment of the original prayer more fully challenging my removal from service 2/5

and the said miscellaneous petition is also pending.

3. In the above said circumstances, now I have decided to withdraw the above writ petition from this Hon'ble Court in order to challenge the impugned order of my removal from service issued by the 09.04.1999 respondent afresh. It is therefore just and necessary that this Hon'ble Court may be pleased to permit me to withdraw the above writ petition by granting liberty to me to file a fresh writ petition otherwise I will be put to great loss and hardship".

3.In view of the above said affidavit, the petitioner is permitted to withdraw the writ petition with liberty to challenge the order of dismissal, dated 09.04.1999, if he so advised.

4.With the above said liberty, the writ petition is disposed of. No costs. 19.09.2025 Index : Yes / No Internet : Yes/ No lr 3/5
