PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the 2nd respondent Police to issue look out circular against the accused in Crime No.02 of 2020 on the file of the Economic Offence Wing, Ramanathapuram.
For petitioner : Mr. Rajiah.L For Respondents : Mr.B.Nambiselvan Additional Public Prosecutor COMMON O RDER These petitions have been filed seeking to direct 2nd and 3rd respondents to file a final report before the concerned Court and to issue look out circular against the accused in the Crime No.02 of 2020 on the file of the Economic Offence Wing, Ramanathapuram.
2. The learned Additional Public Prosecutor would submit that by the order dated 28.03.2022, the direction was issued to the third respondent to complete the investigation. After that, the above said investigation was closed.
3. Now the grievance of the petitioner is that even after lapse of one year, no Final Report has been filed after completion the 3/6
investigation.
4. The third respondent is present before this Court and stated that so far 694 witnesses have been examined and the statement of other victims have to be recorded. Hence, he seeks nine months time to complete the investigation.
5. The learned counsel for the petitioner would submit that status report may be called for from the concerned Police Station, since more than four thousand victims have been identified and it will take some time as stated by the third repsondent Police.
6. Since the crime is of the year 2020, no purpose is going to be served by keep the matter pending. Recording the undertaken given by the third respondent and the learned Additional Public Prosecutor, there shall be a direction to the third respondent to complete the process of investigation within a period of nine months from the date of receipt of copy of this order and the Final Report shall be filed within two months thereafter. After that, the status report may be submitted to the Registry. 4/6
7. With the above said direction, these Criminal Original Petitions stand disposed of.
