Respondents PRAYER: Petition has been filed under Section 11 of the Contempt of Court Act, praying to punish the respondents for their disobedience of the orders of this Court made in W.P.(MD0.No.367 of 2016, dated 05.04.2016 and direct the respondents to obey the order in W.P.(MD).No.367 of 2016, dated 05.04.2016 passed by this Court.

Petition filed under Article 226 of the Constitution of India, praying for issuance a Writ of Mandamus directing the Respondents 1 to 4 to remove the encroachments made in Tank (Kanmai) in Survey No.165, Village No.9, Yembal Group, Andakudi Village, Aavudaiyarkovil Taluk, Pudhukottai District belonging to the Government.

O R D E R

[Order of the Court was made by S.NAGAMUTHU, J.] The petitioner has come up with this contempt petition alleging that the respondents have not complied with the order of this Court, dated 05.04.2016, in W.P.(MD).No.367 of 2016. In the said order, this Court had directed the respondents to act against the encroachments which affect the inflow of water or the storage capacity of the tank in Survey No.165, Village No.9, Yembal Group, Andakudi Village, Aavudaiyarkovil Taluk, Pudukkottai District. 2.Today, when the matter was taken up for hearing, the learned Special Government Pleader submitted that in pursuance of the said directions, already land has been surveyed and notice has also been issued to the encroachers as per the provisions of the encroachment Act. Since substantive action has been taken by the respondents, we are inclined to close this petition. Accordingly, this Contempt Petition is closed. No costs.
