Criminal Original Petition filed under section 482 of Criminal Procedure Code, to direct the respondent to register the complaint made by the petitioner dated 10.03.2022 based on the order passed by the learned Judicial Magistrate No.I, Nagercoil in Crl.M.P.No.3552 of 2022 dated 02.05.2022.

O R D E R

This Criminal Original Petition has been filed to direct the respondent to register the complaint made by the petitioner dated 10.03.2022 based on the order passed by the learned Judicial Magistrate No.I, Nagercoil in Crl.M.P.No.3552 of 2022 dated 02.05.2022.

2. The learned Government Advocate(Crl.Side) would submit that deduction in the salary of the petitioner was made due to some deficiency of his duty.

3. On perusal of the enquiry report it is seen that pursuant to the order passed by the learned Judicial Magistrate No.I, Nagercoil enquiry was conducted and during the course of enquiry it was found that the allegations made in the complaint are not true. If the petitioner got any grievance over the non disbursal of salary amount he can very well approach the Assistant Commissioner of Labour as per the provisions of Payment of Wages Act, the above said enquiry was closed. The report was also submitted to the Court on 27.06.2023 but so far copy was not supplied to the petitioner. After getting copy of the closure report the petitioner can work out his remedy if he is aggrieved over the closure report.

4. With the above direction, the Criminal Original Petition stands disposed of.
