PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to withdraw S.T.C. No. 338 of 2022 on the file of learned District Munsif cum Judicial Magistrate Court, Kadaladi, Ramanathapuram District and to transfer the same on the file of Fast Trach Court No. II (JM Level) Madurai to be tried along with S.T.C. No. 687 of 2022.

ORDER

This Criminal Original Petition has been filed, invoking Section 482 Cr.P.C., to withdraw S.T.C. No. 338 of 2022 on the file of learned District Munsif cum Judicial Magistrate Court, Kadaladi, Ramanathapuram District and to transfer the same on the file of Fast Trach Court No. II (JM Level) Madurai to be tried along with S.T.C. No. 687 of 2022.

2. Heard the learned cousnel for the petitioner and the learned counsel appearing for the first respondent.

3. The learned counsel appearing for the first respondent has no objection to transfer the S.T.C. No. 338 of 2022, from the file of learned District Munsif cum Judicial Magistrate Court, Kadaladi, Ramanathapuram District to the file of Fast Track Court No. II (Judicial Magistrate Level) Madurai.

4. In view of the above, the proceedings in S.T.C. No. 338 of 2022 on the file of the learned District Munsif cum Judicial Magistrate Court, Kadaladi, Ramanathapuram District is withdrawn and ordered to be transferred to the file of the Fast Track Court No. II (Judicial Magistrate Level) Madurai. The learned District Munsif cum Judicial Magistrate Court, Kadaladi, Ramanathapuram District is directed to transmit the entire case records to the Fast Track Court No. II (Judicial Magistrate Level) Madurai within a period of one week from the date of receipt of copy of this order. After receiving the entire records from the learned District Munsif cum Judicial Magistrate Court, Kadaladi, Ramanathapuram District, the Fast Track Court No. II (Judicial Magistrate Level) Madurai, shall take the matter on file along with S.T.C.No.687 of 2022 and assign a new number and also issue notice to 3/5

the parties for their appearance. After appearance of parties, the Fast Track Court No. II (Judicial Magistrate Level) Madurai, shall dispose of the same within a period of three months from the date of appearance of parties. It is informed that the Fast Track Court No. II (Judicial Magistrate Level) Madurai is vacant. Therefore, in-charge of the magistrate shall take care of those matters.

5. With the above directions, this Criminal Original Petition is disposed of. Consequently, the connected miscellaneous petitions are closed.
