Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus by directing the first respondent to cancel the Joint patta No.1796 in favour 3 to 5 respondents and issue separate patta in the petitioner name for the survey No.976/1 and 976/2 extent of 68.5 cents which is situated at Sri Ramapuram Village, Vedasandur Taluk, Dindigul District based on petitioner's representation dated 21.08.2025. 1/4

Patta No.1796 was issued in the name of P.Chellamuthu, P.Nallasamy and N.Lakshmi in respect of survey Nos.975/3B, 976/1 and 976/2. The petitioner asserts that her father-in-law purchased 68.5 cents in undivided survey No.976 under registered sale deed bearing document No.2389 of 1965. After submitting a representation dated 21.08.2025 for inclusion of the petitioner's name in the patta, the present Writ Petition has been filed.

2. Learned counsel for the petitioner submits that the names of respondents 3 to 5 were included in respect of survey Nos.976/1 and 976/2 in respect of the total extent of 1 acre and 37 cents, although 68.5 cents is owned by the petitioner as the legal heir of her husband.

3. Learned Government Advocate accepts notice on behalf of respondents 1 and 2. He submits that the Revenue Divisional Officer 2/4

would consider the petitioner's representation and pass orders on merits within twelve weeks.

4. The Revenue Divisional Officer shall provide a reasonable opportunity to the petitioner and the pattathars under joint Patta No.1796 before taking a decision. In view of this direction, notice to the private respondents is dispensed with.

5. For reasons aforesaid, without making any observations on the merits, this Writ Petition is disposed of by directing the first respondent to consider the petitioner's representation after providing a reasonable opportunity to the petitioner and respondents 3 to 5 and issue a speaking order within a period of (12) weeks from the date of receipt of a copy of this order. No costs.
