: Contemnor/Respondent No.2 PRAYER: Contempt Petition is filed under Section 11 of Contempt of Courts Act, 1971, praying to punish the contemnor/respondent for the deliberate violation and willful disobedience of the order of this Court dated 06.11.2015, made in W.P.(MD)No.20223 of 2015 on the file of this Court.

Prayer in WP(MD). 20223/ 2015 : Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of Certiorarified Mandamus direction in the nature of a writ, call for the records made in Ni.Mu.No.6323/2014 L dated 19.09.2014 passed by the respondent, quash the same and further direct the 3rd respondent to issue community Certificate to the petitioner and to the Children of the petitioner namely Rajakavi, Alagu Meena, Veera Ragavendran as Malaivedan Community declared as Scheduled Tribe forthwith.

ORDER

[Order of the Court was made by R.SUBBIAH, J] This Court, by order dated 06.11.2015, directed the respondent to conduct an enquiry on the appeal filed by the petitioner, by giving opportunity and pass appropriate orders, within a period of eight seeks. Though this Court has given a direction to pass an order, within the specified time, the order was not complied with. https://hcservices.ecourts.gov.in/hcservices/

Hence, he has come forward with the present Contempt Petition.

2. Today, when the matter was taken up for consideration, the learned Government Advocate submitted that the petitioner's appeal was considered and order was passed on 12.12.2016, stating that the petitioner has to work out his remedy before the State Level Committee. He has also produced a copy of the order dated 12.12.2016 for perusal of this Court.

3. In view of the above, since the order of this Court dated 06.11.2015, made in W.P.(MD)No.20223 of 2015, has been complied with, we are of the opinion that nothing survives for adjudication in this Contempt Petition. The Contempt Petition is closed accordingly. However, the petitioner is at liberty to work out his remedy before the State Level Committee. Since the order has been complied with, appearance of the respondent, the District Collector, Madurai District, is dispensed with.
