ORDER
Heard the learned counsel appearing for the writ petitioner and the learned Special Government Pleader appearing for the first respondent. Considering the nature of relief to be granted, issuance of notice to the second respondent is dispensed with.

2.The petitioner claims to be a share holder of the third respondent company. The said company is said to have been struck off. The apprehension of the writ petitioner is that the property belonging to the third respondent, which has now been struck off, may be alienated. The petitioner has already submitted an objection petition in this regard. 3.The learned counsel for the petitioner states that a sale agreement in respect of the third respondent's properties has already been registered and that is why the petitioner has rushed to this Court seeking breathing time. The petitioner states that he will move the jurisdictional civil Court to file an appropriate suit within one week from the date of receipt of a copy of this order.
4.In view of the said submission, the first respondent is restrained from entertaining any document in respect of the properties of the third respondent for a period of eight weeks. It is for the writ petitioner to obtain an interim order from the jurisdictional civil Court in the meanwhile. If the petitioner is unable to obtain interim relief, that does not mean that the first respondent should register any document. The 3/6
first respondent is expected to bear in mind the law while discharging his statutory functions.
5.The fact that this Court granted a restraint order for a period of eight weeks that does not mean that the claim of the writ petitioner has been recognised. Only to give a breathing time to the petitioner such a direction has been issued. The defences and contentions of the private respondents do not stand foreclosed.
