PRAYER: Contempt Petition filed under Section 11 of the Contempt of Courts Act praying to issue statutory Notice and punish the respondents under the provisions of Contempt of Courts Act 1971 for willful and deliberate disobedience of the order passed by this Court in W.P.No.17399 of 2015 dated 25.09.2015. Prayer in WP(MD). 17399/ 2015 :

Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, directing the respondents 1 to 3 to consider the petitioner's representation dated 14.08.2015 and consequently direct the respondents 1 to 3 to remove the encroachment made in the public road in Survey No. 196/25 situates at Varichiyur Village, Madurai East taluk, Madurai District.

************ [Order of the Court was made by K.K.SASIDHARAN, J.] This Contempt petition is filed by the petitioner alleging non-compliance of the order passed by this Court in W.P.(MD). No.17399 of 2015, dated 25.09.2015.

2. The learned Special Government Pleader filed a status report, dated 05.06.2016, indicating that the third respondent has complied with the order.

3. It is always open to the petitioner to approach the appropriate authority, in case obstruction is made by the alleged encroacher. In any case, there is no case made out to punish the respondents.

4. The Contempt Petition is closed with the above observation.
