[Order of the Court was made by R.MAHADEVAN, J.] The prayer in this writ petition is for issuance of a writ of mandamus directing the third respondent to implement his order in Na.Ka.No. 84/2017, dated 03.07.2017, for removal of the encroachment made by the respondents 4 and 5 in the Public Pathway and Government Poramboke land in Survey Nos.2353/09 and 2353/10 of Vadamadurai Village Group, Ward No. 5, Vedasandur Taluk, Dindigul District.

2. Today, when the matter was taken up for hearing, the learned counsel appearing for the fourth respondent submitted that with regard to the lis on hand, the fourth respondent has filed O.S.No.134 of 2014, before the Sub Court, Vedasanthur and the same is pending.

3. Recording the above submission of the learned counsel for the fourth respondent and leaving it open to the parties to agitate their rights in the pending suit, the writ petition is closed. No costs. [R.M.D., J.] [J.S.N.P., J.] 29.09.2022 Index :
