PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of writ of mandamus directing the respondents to issue necessary order or direction to the 5th respondent to refund a sum of Rs.39,050/- (Rupees Thirty Nine Thousand and Fifty Only) to the petitioner.

ORDER

The petitioner had joined B.E (Bio Medical Engineering) in the 5th respondent college on 09.08.2017 and also paid the fee of Rs.1,95,000/-. While so, she discontinued the B.E, course since she joined in MBBS course in some other college. Therefore she has requested the 5th respondent for refund of the entire fee paid by her and the college has repaid a sum of Rs.1,55,450/- and a remaining amount of Rs.39,050/- is yet to be paid.

2.The learned Counsel for the petitioner submits the petitioner has paid the fee of Rs.1,95,000/- while joining in the 5th respondent college, however she has not attended any class. She has discontinued the course and therefore, the 5th respondent college has refunded a sum of 1,55,450/-, but the remaining sum of Rs.39,050/- is not yet paid.

3.There is no representation for the 5th respondent.

4.The allegations raised by the petitioner in this writ petition are not denied. Therefore, this writ petition is disposed with a direction to the 5th respondent to consider the case of the petitioner for repaying the balance amount as per the refund policy fixed by the All India Council for Technical Education, within a period of eight weeks from the date of receipt of a copy of this order.
