Prayer: Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 3 take appropriate action against the fourth respondent based upon the petitioner's representation dated 16.10.2023 and consequently direct the second respondent to take appropriate action against the fourth respondent by following under Section 205 of Tamil Nadu Panchayat Act, 1955.

ORDER

Heard both sides.

2. The petitioner had filed this writ petition for directing the Inspector of Panchayats to take action against the Panchayat President under Section 205 of Tamil Nadu Panchayats Act, 1994.

3. When the matter was taken up for hearing, the learned Special Government Pleader submitted that enquiry process has already been initiated and that enquiry is to be held tomorrow (01.12.2023) evening at 04.30 p.m. 2/4

4. We direct the first respondent to continue the proceedings and take them to their logical conclusion. We make it clear that we have not gone into the merits of the matter. All the contentions and defenses of both the parties are left open. Conclusion of the proceedings shall be duly intimated to the petitioner so that he can take further action as per law.

5. This writ petition disposed of accordingly. There shall be no order as to costs.
