PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondents 2 and 3 to measure petitioner property in survey numbers 72/2, 72/6, 72/8, 72/9 and 72/10 of Chatrapatti Village, Manapparai Taluk, Tiruchirappali District based on petitioner representations dated 05.06.2025 and 23.07.2025. ORDER
By relying on patta Nos.381, 545, 33 and 293, the petitioner had applied for survey of lands in S.Nos. 72/2, 72/6, 72/8, 72/9 and 72/10 of Chattirapatty Village, Manapparai Taluk. The present writ petition relates thereto.
2. Learned Government Advocate accepts notice for all the respondents. He submits that notice would be issued to the joint pattadhar under patta Nos. 381 and 293 and their objections would be considered before a decision is taken.
3. Patta Nos.545 and 33 are separate pattas in the name of the petitioner. On the other hand patta Nos.293 and 381 are joint pattas. Therefore, it is necessary to issue notice to the other joint pattadhars and consider their objections, if any. It is also necessary to issue notice to owners of relevant adjacent lands.
4. Subject to the above observations, this writ petition is disposed of by directing the 2nd and 3rd respondents to initiate action on the petitioner's request for survey after issuing notice to the persons mentioned in the previous paragraph and considering objections, if any, from them. For the avoidance of doubt, it is clarified that the survey shall not be conducted if there is a credible 2/4
