Prayer: Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Certiorarified Mandamus, to call for the records relating to the impugned order relating to the impugned intimation proceedings in Ref.Claims/74T dated 11.02.2017 of the 2nd respondent which is upholding the Repudiation order of the 2nd respondent in his proceedings in Ref.Claims/74T dated 27.03.2014 and quash the same and consequently direct the 2nd respondent to pay the insured amount as per the insurance policies of the deceased to the petitioner within the stipulated period.

ORDER
This writ petition has been filed challenging the order repudiating the claim made by the petitioner on the life insurance policies that had been availed by the petitioner's son, who died on 10.06.2013.
2. In view that there has been a repudiation of the entire claim made by the petitioner, which arises out of a contract that had been entered into between the parties, I am of the view that the writ petition
cannot be entertained and the same could only be adjudicated in an appropriate forum. In view of the same, this Writ Petition is dismissed. However, liberty is granted to the petitioner to approach the appropriate forum as deemed fit by him in the manner known to law. When the petitioner approaches the said forum, the period of pendency of this writ petition shall stand excluded while calculating the period of limitation for initiating the said proceedings. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed. 03.12.2024 NCC : Yes/No Index : Yes/No Internet : Yes abr
