Heard both sides.

2.The order impugned in this writ petition is appealable. It is true that the limitation period has already expired. Be that as it may, the assessee had already paid the entire tax.

3.Considering the grounds urged by the learned counsel for the petitioner and special facts and circumstances of this case, the petitioner 2/4

is permitted to file an appeal before the appellate authority. If the appeal is filed within a period of four weeks from the date of receipt of a copy of this order, it shall be entertained without reference to limitation. The question of paying 10% of the disputed tax amount does not arise at all. 4.This Writ Petition is disposed of accordingly. No costs.
