When the matter came up for hearing today (i.e., 18.03.2025), Ms.Moushika, learned counsel appearing for the respondents 4 and 5 in W.P(MD).No.18780 of 2019 brought to my notice, the judgment and decree passed in O.S.No.287 of 2019 on the file of the learned Principal District Judge at Dindigul, dated 19.01.2024. She states that her client Mr.K.L.Ravi had presented a suit for declaration of his title and for injunction for the properties involved in these two writ petitions. A perusal of the order shows that the suit in O.S.No.287 of 2019 has been decreed with costs on the aforesaid date.
3. Mr.D.Anbarasu appearing for the petitioner in W.P(MD).No. 18780 of 2019 and the seventh respondent in W.P(MD).No.21098 of 2017 states that his client has instructed him to file an appeal and the same has also been presented in A.S(MD)(SR).No.30998 of 2024 on the file of this Court.
4. When it comes to matters of title, no revenue authority can go into the same. It is the duty and jurisdiction of the civil Court to probe into it, when a suit for title and such appropriate reliefs are presented. As 4/7
per the Standing Orders of the Board of Revenue, where title has been declared by the Civil Court for a particular property, it is the duty of the revenue authorities to bring their records in line with the civil Court decree. That being the position, the revenue authority shall strictly follow the judgment and decree made in O.S.No.287 of 2019, dated 19.01.2024 and shall update the records accordingly.
5. In the event, the appeal preferred by Mr.K.Muthuramalingam succeeds, the same result shall ensue. Suffice it to state that, as the suit has been decreed, no further orders are necessary in these writ petitions. Accordingly, both Writ Petitions are closed. No costs.
