Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to give police protection to install the Survey Stone in the petitioner land in Survey No.87/2B1, Samusigapuram Village, Rajapalayam Taluk, Virudhunagar District in total extent of 1 Acre 84 cents and sold out of remaining area of extent of 20.65 cents and coverted plot area in the Plot No.9A and Boundaries East North 18 Feet East South 18 Feet South North 15 Feet South East 15 Feet plot 270 Square Feet in equal to 25.08 Square Meter of land and also protect the petitioner life and limb of the property. ORDER

The Writ Petition is filed for Mandamus to direct the respondents to give police protection to install survey stones for the petitioner's land measuring 1 Acre 84 cents in Survey No.87/2B1, Samusigapuram Village, Rajapalayam Taluk, Virudhunagar District.

2. Even according to the petitioner, police protection is sought only because the neighbouring land owners are disputing the boundaries.

The learned Additional Public Prosecutor, on instructions, would submit that based on the petitioner's complaint, the petitioner and his neighbour were called for enquiry; that during the course of enquiry, both the parties had undertaken not to lay the survey stones until the land is measured by the Surveyor; and that recording the said undertaking, the enquiry was closed.

4. This Court is of the view that when there is a dispute between the petitioner and his neighbour with regard to the boundaries, the respondent Police cannot interfere with the same. It is for the Civil Court to determine the right of the petitioner. In such circumstances, the direction as sought for by the petitioner cannot be issued.

5. At this stage, the learned Additional Public Prosecutor would submit that if a request is made by a Surveyor seeking police protection to measure the land, the same would be considered.
