ORDER

This Contempt Petition arises out of the non-compliance of the order dated 03.02.2021 made in W.P.(MD)No.5969 of 2012. The relevant portion of the order is extracted hereunder:- 1/4

"11.For the reasons above stated, the order impugned in the present Writ Petition is set aside and the matter is remitted back to the authorities to rework the entire issue and refix the seniority of the drivers as per the Regulations of the Tamil Nadu Electricity Board, in the appropriate place including petitioner, after affording an opportunity of hearing to the petitioner, sixth respondent and other affected persons. Accordingly, the writ petition stands allowed. No costs. Consequently, the connected miscellaneous petition is closed."

2.When the matter was taken up for hearing on 20.12.2023, Ms.Parameswari, learned counsel took notice for the respondent and sought time to get instructions. Today, she reports that panel has been re-worked and final orders are yet to be passed, since the Superintending Engineer is not currently available in Dindigul District, but has been sent for flood relief work at Tirunelveli. She further states that re-fixation order will be issued on or before 28.12.2023.

3.The said statement is taken on record and there shall be a direction to the respondent to complete the proceedings as per the statement made by the learned counsel for the respondent, on or before 28.12.2023. 2/4
