PRAYER: Criminal Original Petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, praying this Court to call for the records pertaining to the impugned FIR in Crime No.09/2024, on the file of the first respondent police and quash the same insofar as the petitioner is concerned. ORDER
This Criminal Original Petition has been filed to quash the impugned FIR in Crime No.09/2024, on the file of the first respondent police. 2.The learned Senior Counsel appearing for the Accused No.2 / motherin-law of the second respondent / de-facto complainant submits that there is no iota of material against the petitioner in the complaint as well as in the FIR and hence seeks for quashing of the FIR.
3.The learned Additional Public Prosecutor submitted that in this case, investigation has been completed and charge sheet has been filed. He further submitted that the petitioner along with her sons had approached this Court for anticipatory bail and this Court, by order dated 04.09.2024, dismissed the anticipatory bail application finding that the petitioners were holding some gold jewels of the de-facto complainant and they have not returned the same to the de-facto complainant. Aggrieved against the dismissal, the petitioner's sons have approached the Apex Court and the Apex Court has directed the petitioners to seek regular appeal. In the mean time, A1 and A2 got surrendered and later, they were let out on bail. It is further submitted that the 2/6
investigation is completed and charge sheet filed and registration number is yet to be assigned.
4.The learned Counsel for the second respondent / de-facto complainant objected for the petitioner's submission that there are no averments against the petitioner. At the instance of the petitioner, the first accused, the husband of the de-facto complainant had committed harassment and cruelty to the defacto complainant. 5.The learned Senior Counsel for the petitioner submitted that the defacto complainant's jewels of more than 100 sovereigns have been retained by her husband and his family members. Now, charge sheet filed and this petition becomes infructuous.
6.Considering the above submissions, it is seen that now investigation is completed and charge sheet filed against all the petitioners. In view of the same, the petitioner is permitted to withdraw this petition, with liberty to file a fresh application, challenging the charge sheet. Till then, no affirmative action shall be taken by the respondent police. 3/6
7.Accordingly, this Criminal Original Petition is dismissed as withdrawn, with liberty to challenge the charge sheet. Consequently, the connected miscellaneous petition is closed.
