O R D E R

This contempt petition is filed that the order of this Court in WMP(MD) No.18565 of 2023 in WP(MD) No.22282 of 2023, dated 20.09.2023 has not been complied with. 2.The petitioner, with a grievance that the respondent has issued a tender notification, identified his property as a suitable 2/6

place for starting a Branch of the Union Bank of India, Salai Street Branch, Ramanathapuram, awarded a contract, based on which, the petitioner has invested huge amount for putting up a safety wallet, etc., however, the respondent Bank has unilaterally cancelled the tender notification, by order dated 24.08.2023, has filed a writ petition in WP(MD) No.22282 of 2023 before this Court, challenging the cancellation of tender notification and also sought for interim injunction, restraining the respondents 2 & 3 from calling for any fresh tender notification in respect of premises for Union Bank of India, Salai Street Branch, Ramanathapuram. This Court, by order dated 20.09.2023 has passed an order, granting an interim injunction for a period of two weeks and it has not been subsequently extended further. By referring the subsequent tender notification issued by the respondent Bank, the petitioner has filed this contempt petition that despite the interim order of this Court, dated 20.09.2023, the respondent Bank has issued a fresh tender notification.

3.The learned counsel appearing for the respondent Bank submits that the tender notification now issued is only for the Union Bank of India, Government Hospital Road Branch and not meant for Salai Street Branch.

4.Recording the submission made on behalf of the respondent Bank and considering the scope of the contempt petition, this Court is not inclined to entertain this contempt petition. Accordingly, this contempt petition is closed, with liberty to the petitioner to file a civil suit, for the damages, if any. 29.11.2024 Index:Yes/No Internet:Yes/No vrn 4/6
