ORDER

This criminal original petition has been filed to quash the impugned final report in C.C.No. 237 of 2022 on the file of the learned Judicial Magistrate, Ambasamudram.

2.After hearing the learned counsel for the petitioners, this Court is not inclined to quash the proceedings. Hence, a request was made to dispense with the personal appearance of the petitioners before the trial Court, since the second petitioner is in abroad. 3.Since the second petitioner is in abroad, the personal appearance of the second petitioner before the trial Court in this case alone is dispensed with the following condition.

(i)The second petitioner shall appear before the learned Judicial Magistrate, Ambasamudram, within a period of 15 days from the date of receipt of a copy of this order and file an undertaking affidavit, by affixing their recent passport size photograph, to the effect that he will appear before the trial Court as and when required and must ensure his 2/4

proper representation through Advocate.

The first petitioner must appear before the trial Court. 4.With the above directions, this criminal original petition is dismissed. Consequently, connected miscellaneous petitions are closed. 08.11.2023 NCC :
