O R D E R

This contempt petition has been filed alleging wilful disobedience of the order passed in W.P(MD)No.22865 of 2015 dated 18.12.2015.

2.The learned standing counsel for the respondent by referring the counter filed on behalf of the respondent would argue that the order passed in the writ petition has been complied with by virtue of the order issued in Memo No.1220/A3/A32/2016-5 dated 28.03.2016, in which, the petitioner's name was included in the panel and consequential issuance of promotional order dated 07.04.2017 and he is also assumed charge in the post of Internal Audit Officer on 10.04.2017.

3.The learned counsel for the petitioner would state that it was only a regular promotion and no promotion was given to the petitioner as per the terms of Memo.(Per)No.20233/A3/A32/2006-24 https://hcservices.ecourts.gov.in/hcservices/

dated 03.04.2010.

4.Admittedly, in the instant case, name of the petitioner was included in the panel for promotion by a proceedings dated 28.03.2016 and he assumed office as Internal Audit Officer on 10.04.2017. Therefore, the contempt petition is closed with liberty to the petitioner to challenge the same, if he so advised. No costs.
