The Civil Miscellaneous Petition has been filed seeking orders to condone the delay of 48 days in filing the appal against the judgment and decree, dated 21.12.2023 in A.S.No.1 of 2022 on the file of the Principal District Court, Karur, reversing the judgment and decree, dated 20.02.2017 in O.S.No.311 of 2010 on the file of the Principal Subordinate Court, Karur.

2. Heard the learned counsel for the petitioner, learned counsel for the respondent and also perused the records.

3.The learned counsel for the respondent would submit that they are not having objections to allow this petition.

4.Considering the reasons assigned and also taking note of the quantum of delay, this Court is inclined to condone the delay. Accordingly, this petition is ordered and the Registry is directed to take the appeal on file, if it is otherwise in order and list the matter in the usual course.
