Prayer: Petition filed under Section 11 of the Contempt of Court Act, 1971, to punish the respondent for his wilful disobedience of the order dated 15.12.2015 in WP(MD)No.15181 of 2013. Prayer in WP(MD). 15181/ 2013 :

Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue Writ of CERTIORARIFIED MANDAMUS calling for the records relating to the impugned order passed by the 3rd respondent in his proceedings in Na.ka.No.2228/m2/M2/2013 dated 29.07.2013 and quash the same as illegal and consequentially to direct the respondents to consider the petitioners for promotion to the post of B.T.Assistant (Maths) in the Panchayat Union Middle School, Thottanampatti, Vedachandur union, Dindigul DIstrict as per the panel of Secondary Grade Teachers fit for promotion to the post of B.T.Assistant (Maths) as on 01.01.2013 within the period that may be stipulated by this Hon'ble Court.

This Contempt Petition has been filed to punish the respondent for willfully disobeying the order of this court made in WP(MD)No.15181 of 2013, dated 15.12.2015.

2.It is represented by the learned Special Government Pleader that pursuant to the order of this court, dated 15.12.2015 passed in WP(MD)No.15181 of 2015, the petitioner is now promoted as BT Assistant.

3.On the other hand, the learned counsel for the petitioner would submit that the petitioner is entitled for promotion from 2013, but an order was passed giving promotion in the year 2017, thereby the seniority of the petitioner has been affected. 4.However, recording the above submissions, this contempt petition is closed with liberty to the petitioner to challenge the order of seniority in the manner known to law.
