Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records relating to the Impugned Order passed by the 3rd respondent in his Proceedings in Na.Ka.No.1500/1515/A2/Aa2/2013 dated 11.10.2013 and quash the same as illegal and consequentially to direct the respondents to consider the petitioner for promotion to the post of B.T. Assistant (English) in the Panchayat Union Middle School, Thottanampatti, Vedachandur Union, Dindigul district, as per the panel of Secondary Grade Teachers fit for promotion to the post of B.T. Assistant (English) as on 01.01.2013 within the period that may be stipulated by this Honourable Court.

ORDER

The contempt petition has been filed to punish the respondent for willful disobedience of the order dated 15.12.2015 in W.P.(MD) No.161 of 2014.

2. Heard Mr.T.Pon Ramkumar learned counsel for the petitioner, Mr.C.Selvaraj, learned Special Government Pleader for the respondent and perused the records.

3. The learned Special Government Pleader appearing for the respondent would submit that the order of this Court has been complied with.

4.On the other hand, the learned counsel for the petitioner would submit that the petitioner is entitled for promotion from 2013, but an order was passed giving promotion in the year 2017, thereby the seniority of the petitioner has been affected. 5.Recording the statement of learned Special Government Pleader appearing for the respondent, this contempt petition is closed with liberty to the petitioner to challenge the order of seniority in the manner known to law.
