No.15909 of 2022:- Criminal Miscellaneous Petition filed Under Sectin 482 of Cr.P.C. to relax the condition imposed by this Hon`ble Court through order in Crl.A(MD)No.712/2022 dated 14.11.2022. Prayer in Crl.A.(MD)No.712 of 2022:- This Criminal Appeal has been filed under Section 14(A)(2) SC/ST (POA) Act, to call for the records pertaining to order passed by the Sessions Judge Special Court for exclusive trial of cases under SC/ST (POA) Act, 1989, Sivagangai in Crl.M.P.No.1438 of 2022 dated 31.10.2022 and set aside the same and release the appellant/petitioner on bail in Cr.No.36 of 2022 on the file of the second respondent.

ORDER:- This Criminal Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/s. G. Thiruvarutselvan, Advocate for the Petitioner and of Mr. R. Suresh Kumar, Government Advocate (Crl.Side) for the 1st & 2nd respondents, this Court made the following order:

This petition has been filed to relax the condition imposed on the petitioner in Crl.A(MD)No.712 of 2022 on 14.11.2022.

2. The learned counsel for the petitioner submitted that the petitioner has been complying with the condition regularly and he prayed for relaxation of the said condition.

3.The learned Additional Public Prosecutor submitted that the petitioner has been complying with the condition regularly and there is no subsequent development or problem between the defacto complainant and the petitioner herein. Further he would submit that Final Report is also made ready.

4.Taking into consideration of the submissions made by both the counsels, the condition imposed by this court in Crl.A(MD)No.712 of 2022 on 14.11.2022 is relaxed and the petitioner shall report before the respondent police as and when required for interrogation.
