PRAYER: Petition filed under Section 11 of Contempt of Courts Act, 1971, to punish the respondents for willful disobedience of the orders passed by this Court dated 13.10.2022 in W.P.(MD)No.14840 of 2019. For Petitioner : Mr.V.Balaji For Respondents : Mr.S.P.Maharajan, Special Government Pleader

ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) This Contempt Petition has been filed to punish the respondents for their wilful disobedience of the order of this Court dated 13.10.2022 passed in W.P.(MD)No.14840 of 2019, wherein this Court passed the following order:- "4.In view of the above submissions, the authority concerned is directed to remove the encroachments made by the respondents 6 to 9 in the subject area, after giving due notice and sufficient opportunity to all the parties concerned and by following due process of law, within a period of eight (8) weeks from the date of receipt of a copy of this order.

5.With the above direction, this Writ Petition is disposed of. No costs."

2.With reference to the directions issued, the learned Special Government Pleader by relying on the counter affidavit filed by the Tahsildar, 2/5

Dindigul West Taluk, Dindigul District, has contended that the encroachments were removed. Paragraph No.4 of the counter affidavit reads as under:- "4.It is humbly submitted that on receiving the order copy in W.P.(MD)No.14840 of 2019, the authorities concerned has taken the steps to remove the encroachments in the above said Survey No. 612/17 to an extent of 0.07.50 Ares in Kuttathupatti Village, Dindigul West Taluk, occupied by Tr.Ponnusamy having cattle shed. The Revenue Authorities and Block Development Officer, Reddiyarchatram has taken action and removed the encroachment on 08.11.2023 the action taken report has been enclosed herewith for the perusal of this Hon'ble Court."

3.In view of the fact that the order of this Court has been complied with, the respondents have not committed any wilful disobedience. Therefore, this Contempt Petition stands closed.
