PRAYER: Writ Petition filed under Article 226 of the constitution of India, to issue a writ of Certiorari, calling for the records relating to the proceedings of the Impugned Order dated 01.06.2017 on the file of the 2nd Respondent and the consequent Impugned Order in Na.Ka.No.5473/2017/Sapa.1 dated 13.10.17 on the file of the 1st Respondent and quash the same.

ORDER

Heard Mr. G.Prabhu Rajadurai, Learned Counsel appearing for the Petitioner and Mr. D.Gandhiraj, Learned Counsel representing the Respondents, and perused the materials placed on record, apart from the pleadings of the parties.

The Writ Petition challenges the order dated 01.06.2017 passed by the Second Respondent, which has been confirmed by the order in Na. Ka. No.5473/2017/Sapa.1 dated 13.10.2017 by the First Respondent.

Learned Counsel appearing for the Petitioner submits that the Petitioner intends to file review of the impugned order dated 13.10.2017 passed by the First Respondent under Section 154 of Cohttps://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P. (MD) No.21885 of 2017 operative Societies Act, 1983, and seeks permission of this Court to withdraw the Writ Petition. He has also filed a memo dated 14.07.2021 to that effect through e-mail which is placed on record. 4.

In the result, the Writ Petition is dismissed as withdrawn granting such liberty. It is made clear that for the purpose of reckoning limitation for review petition before the First Respondent, the period from the date of filing of the Writ Petition, viz., 27.11.2017 till the date on which the certified copy of this order is made ready by the Registry, shall be excluded. Consequently, connected miscellaneous petition is closed. No costs.
