The petitioner seeks issuance of writ of mandamus to direct the respondents to reclassify and surrender the petitioner's land of an extent of 1 acre 50 cents comprises in Survey No.1/1A1 in Karuppappillayendhal Village, Madurai East Taluk.
2. Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents.
3. The learned counsel for the petitioner took me through the affidavit in support of the writ petition and submitted that the respondents are obligated to reclassify the lands and consequently, surrender the partitioner's land measuring 1 acre and 50 cents.
4. However, the learned Government Advocate, on instructions, submit that subject Survey No.1/1A1, measuring 0.60.50 Hectares has been classified 2/4
in the village account as Government Poramboke with remark, PWD quarters and PWD Salai. He would therfore submit that the petitioner's request cannot be entertained.
5. Be that as it may, the petitioner only seeks for reclassification based on his request, dated 20.07.2017. Therefore, this writ petition is disposed of, directing the 3rd respondent to pass suitable orders on the petitioner's application, dated 20.07.2017, on merits and in accordance with law, after affording an opportunity of personal hearing to the petitioner, within a period of eight (8) weeks from the date of receipt of copy of this order.
6. With the above directions, this Writ Petition stands disposed of. No costs.
