This petition has been filed to call for the records and quash the maintenance case in M.C.No.13 of 2013 on the file of the learned Judicial Magistrate, Dhevakottai.

2.When the matter was taken up for hearing on 13.02.2018, it was represented that the learned counsel appearing for the petitioner is no more. Hence, this Court directed the Registry to issue notice to the petitioner returnable by 27.02.2018. Thereafter, when the matter was taken up for hearing on 27.02.2018, service was awaited and the same was posted on 12.03.2018. Again the matter was taken up for hearing on that day, there was no representation on behalf of the petitioner and it was posted under the caption' for dismissal' on 14.03.2018.

3.Today (i.e on 14.03.2018) when the matter is taken up for hearing, there is no representation on behalf of the petitioner. In such circumstances, the attitude of the petitioner shows that he is not having any interest in proceeding the case. Accordingly, this criminal original petition is dismissed for non prosecution.
