ORDER

The petitioners are accused nos.1 & 2. They were tried for the offence u/s.506(i), 366, 366(A), 201 IPC and Section 11(iv) r/w 12, 5(n)(1)(g), 6 of POCSO Act. The trial Court found them guilty, convicted and sentenced them. Challenging the conviction and 1/3

sentence, the petitioners have filed Crl.A(MD)No.548 of 2023. Pending the appeal, the petitioners have moved this application to suspend the sentence. 2.When the application is taken up for hearing today, learned Counsel for the petitioners sought for an adjournment.

3.It appears that this application is pending from 20.11.2023. Repeatedly, the case has been adjourned at the request of either of the parties. Even today, the petitioners are not ready to prosecute the application. Therefore, this Court is not inclined to consider the request of the petitioners' Counsel for adjournment. At this juncture, the petitioners' Counsel sought permission to withdraw the application. He has also made an endorsement to that effect.

4.In view of the above submission and the endorsement so made, this miscellaneous petition stands dismissed as withdrawn.
