Prayer : Criminal Original Petition is filed under Section 528 of BNSS, 2023, To pass an order directing the 1st Respondent to transfer the investigation from the 3rd Respondent in Cr.No.130 of 2025 on the file of 3rd Respondent,the Sengipatti Police Station,Thanjavur to any other independent agency concerned and to proper in the circumstances of the case. ORDER

This Petition is filed to direct the first respondent to transfer the investigation from the third respondent in Crime No.130 of 2025 to any other independent agency.

2. The learned counsel for the petitioner would submit that this petition has been filed mainly on the ground that though the victim died, the respondents have not altered the offence to Section 103 BNS (302 I.P.C) and that none of the accused persons were apprehended.

3. The learned Additional Public Prosecutor, on instructions, would submit that A1 to A4, A9 and A10 were all arrested and the offence has been altered to Section 103 BNS (302 IPC) .

4. In view of the aforesaid submission, there is no reason to transfer the investigation. However, the respondents shall conclude the investigation as expeditiously as possible and file the final report. 2/4

5. With the above direction, this Criminal Original Petition is disposed of.
