PRAYER: Criminal Original petition filed under Section 407 of Code of Criminal Procedure, to pass an order withdrawing the case in C.C.No.220 of 2012 on the file of the learned Judicial magistrate No.II, Nagercoil, Kanyakumari District and transfer to any other Court in the neighboring Tirunelveli District more particularly the learned Judicial Magistrate Valliyur, Thirunelveli forthwith. O R D E R

This Criminal Original Petition has been filed by the accused in C.C.No.220 of 2012 on the file of the learned Judicial Magistrate No.II, Nagercoil, Kanyakumari District, to transfer the aforesaid case to any other Court in Tirunelveli District. 2.The learned counsel for the petitioner submitted that during pendency of the above petition, the petitioner / accused No.1 died on 18.08.2015, the charges against him in the aforesaid case has been abated and hence, nothing survives for further adjudication in the matter.

3.The learned Government Advocate (Crl.Side) appearing for the respondents submitted that the petitioner / accused No.1 died on 18.08.2015.
