Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorari, to call for the records pertaining to the impugned order passed by the first respondent in his proceedings in Na.Ka.No.5538/A4/2022 dated 10.10.2022 and quash the same as illegal.

ORDER

Heard both sides.

2.The petitioner questions the impugned order dated 10.10.2022 passed by the first respondent at the instance of the fourth respondent. Admittedly, the impugned order has been passed by invoking Circular No.41530/U1/2017 dated 08.11.2017, 31.07.2018 and 09.11.2018 issued by the Inspector General of Registration. When the subsequently incorporated Section 77A of the Registration Act, 1908 itself has been struck down, obviously, the orders passed by invoking the circulars 2/4

issued cannot survive. The parties will have to agitate their claims only before the jurisdictional civil Court. I make it clear that I have not gone into the issues of title. In this view of the matter, the order impugned in this writ petition is set aside.

3.This Writ Petition is allowed accordingly. No costs.
