This Criminal Original Petition has been filed for quashing the complaint filed by the respondent herein under Section 138 of Negotiable Instruments Act, before the learned Judicial Magistrate, Eraniel in C.C.No.2923 of 2012.

2.Heard both sides.

3.The grounds raised in this quash petition can very well be urged by the petitioner before the trial Magistrate. Considering the fact that the petitioner is a senior citizen, the relief of dispensing with the personal appearance of petitioner is granted. However, the petitioner shall appear before the trial Court as and when required.
