Mr.R.Sureshkumar, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 260 of 2023 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 379 IPC r/w. Section 21(1) of Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.260 of 2023 on the file of the respondent police, seeks anticipatory bail. 1/3

2. The case of the prosecution is that on 23.10.2023, when the respondent police has made inspection and at that time the petitioner herein and other accused have illegally transported Savudu Sand kept in agriculture land belonging to A1 without valid permit. Hence the case.

3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case.

4. The learned Government Advocate (Crl. Side) appearing for the respondent would submit that the petitioner herein is having one previous case in similar nature and hence, strongly objected to grant anticipatory bail to the petitioner.

4. Considering the serious nature of allegations made against the petitioner and that the petitioner is having previous case, this Court is not inclined to anticipatory bail to the petitioner.
