Prayer in Habeas Corpus Petition(MD) No.832/ 2010 : Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Habeas Corpus orany other writ or order or direction of a like nature directing the respondents to produce body or person of the detenue Mr.Rajarathinam aged about 30 years before this Court and hand over his custody to the petitioner.

*********** [Order of the Court was made by K.K.SASIDHARAN, J.] The Inspector of Police, Karungal Police Station, Kanyakumari District, filed a status report. In the very same matter, the respondent has earlier filed a counter affidavit.

2. We have perused the counter affidavit filed by Mr.Krishnasami, presently working as Deputy Superintendent of Police, Karur and the status report filed by Mr.R.Madhavan, https://hcservices.ecourts.gov.in/hcservices/

Inspector of Police, Karungal Police Station, Kanyakumari District. It is found from the counter affidavit and the status report that the police have taken follow up action, pursuant to the order dated 25.11.2011 in H.C.P.(MD).No.832 of 2010. The present Inspector of Police undertakes to pursue the matter, taking into account the spirit of the order, dated 25.11.2011 in H.C.P.(MD).No.832 of 2010.

3. In view of the said undertaking, we close the Contempt Petition. However, we make it clear that in case there is no effective step taken by the police, pursuant to the earlier order of this Court, the Contempt Petition will be re-opened for proceeding further.
