Heard Mr.C.Jeganathan, For M/s.Veera Associates, learned counsel for the petitioner and Mr.R.Suresh Kumar, learned Additional Government Pleader for the respondents.

2. The challenge in the Writ Petition is to the refusal to grant B memo in respect of the Government poromboke land which the petitioner proposes to use.

3. It is to be noted that the petitioner had been originally issued with a notice under Section 6 of Act,1905 which he had also challenged in the writ petition before this Court in W.P.(MD)No.21107 of 2017 and this Court vide order dated 16.11.2017 had directed the petitioner herein to submit his explanation and thereafter the second respondent herein was directed to pass orders. Since the proceedings have been initiated under Section 6 of Act 1905, there is no question of issuing B memo for encroachment that had been made by the petitioner. 2/4

4. Hence, there is no merits in the Writ Petition and accordingly, the Writ Petition stands dismissed. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed. 04.12.2024 NCC:yes/no Index:yes/no Internet:yes/no Nsr To:
