Prayer in WP(MD). 176/ 2016 :

Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of Mandamus, directing the respondents to pay the subsistence allowance for the period of suspension from 27.05.2013 along with arrears of salary which is due and payable to the petitioner with interest for such delayed payment, by considering the petitioners representation dated 22.08.2015 and consequently issue a direction to the respondents to reinstate the petitioner in service in the post of shop supervisor.

ORDER

This Court, by the order dated 06.01.2016 issued a direction to the third respondent in W.P(MD)No.176 of 2016 to pass orders on the representation praying for subsistence allowance, dated 22.08.2015, made by the petitioner, within a period of six weeks from the date of receipt of the copy of the order. https://hcservices.ecourts.gov.in/hcservices/

2.Contending that there is non-compliance of the order and the conduct exhibited by the respondent amounted to willfull disobedience to the order passed by the Court, the present Contempt Petition has been filed.

3.The learned counsel appearing for the respondent submitted that the representation of the petitioner has been considered and the request was rejected, as per Rules and the same was also intimated to the petitioner, vide proceedings, dated 31.05.2016, made in Na.Ka.No.C/73/2016.

4.Nothing survives for adjudication as the compliance has been reported. Hence, the contempt petition is closed.
