O R D E R
This writ petition has been filed for a Writ of Certiorarified Mandamus, calling for the records relating to the impugned proceedings of the second respondent in Na.Ka.No.2837/Aa3/2025 dated 03.09.2025 and quash the same as illegal and consequently direct the respondents to disburse the salary to all the 65 employees of the college as approved by IFHRMS for the month of August 2025 onwards within the period that may be stipulated by this Court.
2. The issue involved in the Writ Petition with regard to the payment of salary to the teaching and non-teaching staff in the petitioner's institution namely, Sri Kumara Gurupara Swamigal Arts College.

The learned Additional Government Pleader appearing for the respondents, on instructions, would submit that in respect of 6 persons, whose appointments were approved w.e.f. 27.04.2023, financial sanction is yet to be accorded by the Government. Therefore, the Management ought to have submitted two different bills in respect of 59 staff and 6 staff, whose appointment were approved w.e.f 27.04.2023. He would further submit that if the Management submitted two separate bills, necessary sanction will be accordered to 59 employees, whose approval were made earlier and with regard to the 6 staff, whose approval were made on 15.09.2023 with effect from 27.04.2023, will be disbursed as and when sanction as accorded by the Government.

This Court, unable to comprehend with the submission made by the learned Additional Government Pleader for the simple reasons that those 6 persons, whose appointments were approved on 15.09.2023 were appointed in a sanctioned post in the petitioner institution. When the post is sanctioned, financial sanction is also accorded to this post on the date of sanctions. Therefore, there can be no further financial sanction from the Government. In such a view of the matter, the respondents are directed to disburse the salary for both teaching and non-teaching staff 3/6
in the petitioner's institution forthwith. The arrears of the salary for the six individual, whose post for which approval was granted on 15.09.2023 shall be paid within a period of twelve weeks thereafter. The respondents are also directed to release atleast part of the salary on or before 17.10.2025 taking into consideration of the festival of Diwali.
5. In view of the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently connected Miscellaneous Petitions are closed.
